Key Stages of Conveyancing

Understanding what happens at each stage can take some of the uncertainty out of the process.

It begins when a seller accepts an offer on a subject-to-contract basis. At this point, nothing is legally binding and either party can withdraw without penalty, which is why it’s important not to make firm commitments until contracts have been exchanged.

Once both parties are ready to proceed, solicitors are instructed and the legal work gets underway. For buyers, this stage involves carrying out searches and reviewing any survey findings. The principle of caveat emptor (buyer beware) applies here, so it’s important to raise any concerns before moving forward.

Exchange of contracts is the point at which the transaction becomes legally binding. After exchange, withdrawing from the sale carries financial penalties for both parties, so it’s a significant milestone.

Completion follows, usually a week or two later. This is when funds transfer and ownership formally changes hands and the keys are yours.

Building Safety Act 2022

Following the introduction of the Building Safety Act 2022, GSB is not currently able to act on transactions involving properties over five storeys or 11 metres in height. We will update our position as further guidance becomes available.

A conveyancing solicitor manages the legal side of buying or selling a property. The conveyancing process typically takes between eight and twelve weeks, though this can vary depending on the complexity of the transaction and how quickly searches and surveys are returned. Your GSB solicitor will keep you updated throughout and flag anything that might affect your timeline. 

While it is technically possible to handle conveyancing yourself, it is rarely advisable. Property transactions involve complex legal and financial obligations, and most mortgage lenders require a qualified solicitor to act on their behalf. Using an accredited firm like GSB gives you the reassurance that the process is being handled correctly.
