What is Considered a "Failure to Stop" Offence?

If you neglect to stop or exchange sufficient details following an accident, it is referred to as ‘failure to stop’. If a driver then fails to promptly report the accident to the police, or at the very latest within 24 hours of the incident, it is known as ‘failure to report’. 

Potential Consequences of Failing to Stop

In order for the court to decide whether you are guilty of the offence, they will establish the reasons why you departed, the knowledge of the accident and the seriousness of the incident. If it can be argued that you were oblivious to the accident, then this may be grounds to challenge the prosecution.

If you are found guilty of either failure to stop or failure to report, it can lead to the endorsement of up to ten penalty points on your driving licence and the potential risk of being disqualified from driving.
