FAQs

It is often difficult to say how much divorce proceedings will cost due to the unique nature of each situation. However, to try and assist with this we offer fixed fees for certain aspects of the case.

Please get in touch with a member of the family law team to discuss our fees in more detail. We are always happy to discuss costs with you on a no-obligation basis.

Under the no-fault divorce system, a couple can now divorce without having to explain their reasons to Court. You must have been married for at least one year to get divorced.

Either party can apply for the divorce, and you can agree to share the costs between you if you wish.

If you do not know where your ex-partner is, there are options to locate them, but you should explore this with a solicitor who can advise you fully on the best steps.

Yes, both parties should try and reach an agreement on how marital assets should be divided upon divorce. All parties should disclose details of all their assets and liabilities before an agreement is reached on how the finances are divided.

It is important that when you reach that agreement it is formalised in a consent order. This includes if you don’t have any joint assets.

Once the Court approves the consent order it means the parties cannot claim against each other in the future.

If you cannot agree what happens with the matrimonial assets, then you might need to go to Court.

It is very difficult to say how long they will take as everyone’s circumstances are different.

The average time for completing a divorce is around 6-10 months but it can take longer depending on the circumstances.

Legal aid can be available in certain circumstances. You need to have been subject to domestic abuse or be at risk of suffering domestic abuse or children that are in need of protection.

It will be subject to an assessment of your income. It is available for people that are in receipt of certain benefits or that are on a low income and have minimal capital (savings or assets).

We can assess whether you are eligible for legal aid and if not, we can discuss your options with you. Please contact us to undertake a legal aid assessment.
