What is Sexual Assault?

Sexual assault involves sexual touching of another person without their consent. Legally, it is defined as:

“One person intentionally touching another sexually without the other’s consent and without a reasonable belief in that consent.”

Sexual assault is a serious criminal offence, carrying a maximum sentence of up to 10 years’ imprisonment. A more severe offence, known as sexual assault by penetration (commonly referred to as rape), involves non-consensual sexual penetration with a part of the body or an object and carries a maximum penalty of life imprisonment.

Our Process

Sexual assault cases are complex and highly individual. We take a thorough, tailored approach to ensure your defence is carefully managed at every stage.

  • Initial Consultation – We listen to your account, explain the charges and legal definitions and provide clear advice on your rights and options.
  • Reviewing the Evidence – We examine all prosecution material including any CCTV, digital records, witness statements and forensic reports, to identify any weaknesses or inconsistencies in the case against you.
  • Defence Strategy – We build a defence based on the facts, which may involve challenging consent, questioning witness credibility, or exposing flaws in the investigation.
  • Barrister Selection –  We help you choose a barrister with experience in sexual assault defence cases and ensure they are fully prepared to present your defence effectively in court.
  • Representation – We represent you at all pre-trial stages, including police interviews and court hearings. Your barrister will lead your defence at trial, with our full support throughout.

Historic Sexual Assault Allegations

Allegations of historic sexual assault, where the incident is said to have happened months, years, or even decades ago, can be especially difficult to face. Often, there is little to no physical evidence and the case may rely heavily on the complainant’s memory and testimony.

These cases require careful handling. At GSB, we assess every detail, question the consistency of accounts and explore whether there has been any delay in reporting and why. We also investigate whether any supporting evidence still exists, such as communication records or witnesses from the time.

A conviction for historic sexual assault carries serious consequences, including custodial sentences and placement on the sex offenders register. If you’re facing such an allegation, early legal advice is crucial, even if no formal charge has been made yet.
